MEMBERSHIP TERMS ENERGY FITNESS
What rights and obligations do you have as a member with us? What are our obligations to you?
Membership
- Unless otherwise specified, the membership runs from the day you sign up. Upon registration, you will be charged a training fee for the remaining days of the current month. For some memberships, there is also a registration fee (specified in the membership agreement).
- When entering into a training agreement with a commitment period, this period runs from the same date the contract is signed. Contracts with a commitment period cannot be terminated before the commitment period expires. Upon expiration of the commitment period, the contract will automatically be extended by 1 month at a time. At the same time, the contract is adjusted to an ordinary ongoing basis membership with associated terms and conditions and the current price.
- Agreement on interruption of the commitment period is only approved upon presentation of a medical certificate from a doctor showing that the member is not physically able to complete the membership within the commitment period. Any outstanding amounts will fall due in their entirety. Upon termination during the commitment period, the customer will be charged a short-term supplement of NOK 800. Any sick leave/medical certificate does not have retroactive effect; it applies from the date it is received by the training center – both for freezing and termination.
- Upon termination of membership, the membership ceases at the end of the first full calendar month following the month of termination, with one month's paying termination period at the ordinary price. It is not possible to freeze membership during the notice period. The member cannot claim compensation/refund of training fees if the center must be closed due to unforeseen interruptions in operation ('force majeure').
- For memberships that end in periods that are payment-free or where a fixed-term discount is given, point 4 also applies – with one month's paying termination period at the ordinary price after the discounted period is over, unless otherwise specified.
Payment terms direct debit and invoice
- Payment of membership fees is made via direct debit. When a direct debit authorization has been created in the member's bank and ENERGY Fitness has received the authorization in its membership system, the first direct debit can be made. Until the authorization is received, installment payments will be made via manual invoice sent electronically. An invoice fee will then be incurred in addition to the installment amount until the direct debit is created. The agreed installment amount will then be deducted from the member's account in arrears on the 20th of each month regardless of training frequency until the member cancels the membership.
- Failure to attend does not exempt the member from complying with the payment deadlines.
- When changing a bank account, the member must ensure that the bank connection withdraws the agreed monthly amount from the correct account.
Administration of membership
- Membership administration, including freezing and changes to personal information, must be done exclusively via the membership app Membro.
- Membership cancellation can only be done by contacting Customer Service at hei@energyfitness.no. It is exclusively stipulated that such actions cannot be done through other communication channels, including, but not limited to, telephone or otherwise. Deletion of AvtaleGiro authorization, refusal of debit or suspension of payments is not to be considered a valid cancellation or administrative handling of membership. Such measures do not replace correctly completed cancellation, and do not give access to termination or temporary freezing.
- Freezing a membership (ref. point 1, 'Membership administration') costs NOK 33 per month, and must be registered the month before the desired freeze period starts. You can freeze as many months as you want. The membership continues after the freeze ends without further notice. When freezing a contract with a binding period, the freeze period is added to the binding period. The membership cannot be terminated while it is frozen, if you have a payment-free month or where a time-limited discount has been given. To register a termination during the freeze period, the member must cancel the freeze period and then send a termination notice in accordance with point 2, 'Membership administration'. ENERGY will deduct the membership fee according to the type of membership in the month of termination.
- You are responsible for keeping your personal information up to date at all times. You have access to change these in the member portal. ENERGY Fitness disclaims any responsibility for errors in the information you have registered.

Breach of contract
The member is responsible for having correct payment information at all times. The member is responsible for ensuring that payment is made as agreed and notifying the center in the event of absence/errors in direct debit withdrawals. In the event of non-payment by the agreed due date, the claim will be sent to a third party for further recovery. The current rules in accordance with the provisions of the Debt Collection Act will then take effect. In the event of more than 1 missed payment of the membership fee, access to the center will be blocked. If claims remain unpaid after a payment reminder, the remaining contract value will fall due for payment in its entirety.
Access to the center
- After signing up, you download the Membro app. The app works as your digital membership card, and gives you access to the center from your phone. Alternatively, you can buy an access token from a vending machine at the center. See more at energyfitness.no/inngang.
- Your membership is personal, and you are not allowed to let others in on your own membership, nor other members! In case of misuse, access to the center will be automatically blocked for two weeks without a refund of the membership fee, and a fee of NOK 900 will be added, which will be deducted at the next due date. Non-fulfilled requirements will be prosecuted. If you suspect misuse of your membership/key fob, you must report it to EFC as soon as possible so that it can be deactivated/stopped.
- A department may at times be closed or have a reduced offer in connection with, for example, public holidays, maintenance or other things that fall under force majeure. A reduced training offer does not give the right to a refund of membership fees.
Training at the center
- By signing the membership contract, the person declares that they are physically fit to participate in the training activities at the center. Training at ENERGY Fitness is at your own risk, and you are responsible for your belongings brought to the center. ENERGY Fitness disclaims responsibility for loss and damage to persons or objects that occur during or as a result of the undersigned's stay in the fitness center, including loss and damage to clothing and personal property unless the center has acted negligently.
- As a member, you are obliged to familiarize yourself with and follow the center's current center rules, which can be found at energyfitness.no and posted at the center. In the event of a significant breach of these, or a violation of the current guidelines for the use of ENERGY's facilities, ENERGY may choose to terminate your membership. Any outstanding membership fee will not be refunded.
- If a member causes damage to the center or equipment, the person concerned is responsible for compensating the injured party's financial losses, cf. § 4-1.
ENERGY Fitness' rights
- By signing the contract, the member confirms that a voluntary consent is given to video surveillance of the premises, and that the consent is given in accordance with the Personal Data Act § 2 no. 7. The member also agrees that all recordings can be stored for 14 days, and that the purpose of the surveillance is to prevent crime and misuse of ENERGY's facilities and equipment. The member is aware that these recordings can only be viewed by the general manager, and that recordings will only be used in line with the purpose of the surveillance.
- ENERGY may, without notice, index-regulate prices corresponding to the development in the KPI index for the last 12 months, determined by Statistics Norway. Other price changes require 30 days' notice by e-mail or SMS.
- Contract can be transferred to a 3rd party.
- ENERGY is not responsible for preventing or limiting training opportunities due to circumstances beyond ENERGY's control, and which ENERGY could not foresee or avoid as a result of (Force Majeure).
- ENERGY reserves the right to change the current terms and conditions for membership. See updated membership terms at www.energyfitness.no.
- Disputes between the member and ENERGY shall be resolved amicably. If this is unsuccessful, either party may bring the dispute before the ordinary courts.
